Douglas County Commissioners uphold ballot title for voter-initiated and Board-referred measures

Two ballot measures concerning the future structure of the Douglas County Board of County Commissioners will appear on the Nov. 3 General Election ballot.  

The Board upheld the measures following separate Ballot Title Protest Administrative Hearings on Sept. 3 and Sept. 4. The Board has jurisdiction to hear and decide ballot title protests under State Law through a County Resolution. 

Sept. 3 Administrative Hearing
The Issue: The Board of County Commissioners sets the title language for voter-initiated measures. During a public meeting on Aug. 28, the Board set the ballot language for a voter-initiated measure that asks whether to expand the Board from three to five members and provides two options for the composition of the five-member board.  

The Challenge: The challenge heard on Sept. 3 sought to restore the original petition language to the voter-initiated measure, which would have removed the Board’s addition of cost and funding source from the ballot language.  

The Decision: After considering the protest filed by representatives of the petition, the Board unanimously decided to deny the challenge, upholding the ballot title approved by resolution on Aug. 28. 

Sept. 4 Administrative Hearing
The Issue: On Aug. 31, the Board referred a measure to the Nov. 3 General Election ballot asking voters whether all registered Douglas County voters should continue to elect all County Commissioners if the expansion is approved.  

The Challenge: The challenge heard on Sept. 4 sought to remove the Board of County Commissioners-referred measure from the Nov. 3 ballot.  

The Decision: After considering the protest, the Board of County Commissioners voted 2-1 to deny the petitioner’s challenge, keeping the measure on the ballot.
